These Terms of Service ("Terms") govern your use of our website scraping and recommendation service (the "Service") accessible at https://www.upstart.quest. By accessing or using the Service, you ("you" or "user") enter into a binding agreement with us. If you do not agree, do not use the Service. These Terms form a legally binding contract under applicable EU law.
The Service allows users to purchase credits to request automated scraping of their website, content analysis, and generation of personalized recommendations (e.g., pitch texts) for startup promotion. Scraping occurs only at the explicit request of users for websites you own or have permission to analyze. We do not perform unsolicited scraping or store scraped content beyond processing.
You must be at least 18 years old, have full legal capacity, and authority to request scraping of the provided website. You warrant that you own or have permission for the content and indemnify us against claims. You agree not to use the Service for illegal, harmful, or unauthorized purposes, including spam or deception.
The Service operates on a credit-based model. You purchase credits via a payment processor (e.g., Stripe) for a fixed price per credit bundle. Each scraping request consumes one credit. Payments are final; no refunds except as required by EU consumer law (e.g., 14-day withdrawal for distance contracts if not consumed). We may adjust prices with notice.
We collect only name, email, and payment details (via processor) necessary for the Service. No cookies or tracking beyond essentials. See our Privacy Policy for details. As a data controller/processor, we comply with GDPR (EU 2016/679). A Data Processing Addendum (DPA) applies for personal data in scraped content and is available on request.
Recommendations are licensed to you non-exclusively, royalty-free for your business use. You retain ownership of your input content; we claim no rights thereto. Our algorithms, Service technology, and output format remain our intellectual property. You grant us a limited license to use your inputs for Service delivery.
The Service is provided "as is" without warranties, express or implied, including fitness for purpose. Recommendations are AI-generated suggestions only; no guarantee of accuracy, success, or visibility gains. You assume all risks.
Liability is capped at the amount paid by you in the last 12 months. We are not liable for indirect or consequential damages (e.g., lost profits), except for gross negligence, willful misconduct, or as mandatory under EU law. Force majeure applies.
We may suspend or terminate access for breaches, with notice where possible. On termination, unused credits are refunded pro-rata if not due to your fault. You may terminate anytime; data access is provided for 30 days.
These Terms are governed by the laws of the European Union, including mandatory consumer protection rules. EU consumers retain their statutory rights under the law of their country of residence.
Any disputes shall first be attempted to be resolved amicably. For EU consumers, we offer Online Dispute Resolution (ODR) via the European ODR platform at https://ec.europa.eu/consumers/odr/. If no resolution is reached, jurisdiction lies with the courts of the applicable EU Member State.
We may update these Terms with 30 days' notice via email or site. Continued use implies acceptance. You may opt out by ceasing use and requesting refund of unused credits.
